If you are trying to find a good estate planning attorney, the most important questions you should ask relate to the attorney’s experience in this area of the law. Look for an attorney whose practice focuses on estate planning as opposed to someone who only occasionally prepares a will or power of attorney.

It may be more important to know what questions your estate planning attorney should be asking you. A good estate planner will want to know about your basic family structure and your assets and debts, of course, but will also want to know:

  • if you have concerns about any of your beneficiaries
  • if any beneficiaries are receiving or are likely to receive government benefits
  • if the people you intend to name to act on your behalf are reliable and appropriate
  • if you foresee any family issues arising as a result of your plan and how those issues can be avoided
  • if your beneficiary designations on life insurance, retirement plans, bank accounts, etc. reflect your overall wishes
